3. INFORMATION COLLECTION, USE & SHARING

You will be sole owners of the information collected on this website, we will only have access to/collect information that you voluntarily give us via account creation on the website / email or any other direct contact from you or that is generated or received in connection with your use of the Services. We will not sell this information to anyone

If you create your user account to use our products & services offered on Getepay.in, you are asked for your Personal Information such as your full name, email address and mobile number for records. We may collect and store your sensitive personal data or Information (such as your financial information such as your credit card, debit card details, your bank account information and KYC (Know your customer) documents as per RBI regulations and any other information that may be applicable) that you may choose to save in your user account created with Getepay.in. However, we do not intentionally collect or retain full card numbers, CVV, PIN, or similar payment authentication credentials except to the limited extent permitted by Applicable Laws or Regulatory Guidelines and through compliant systems and controls
  • c. Your email address is used to send you newsletters, updates, service-related communications, transaction related notifications, and news etc (if you subscribe to our newsletter during signup, or any time post your signup) If you do not want to receive communications from us that are not relevant to you or your use of our services, please click on the unsubscribe link provided at the bottom of such e-mails sent to you by us. Service related communications, transaction-related notifications.
  • d. Your mobile number will be use to send you transaction alerts and SMS alerts based on your preferences. If you do not wish to receive such SMS’s from us, please notify us at info@getepay.in to stop the same.
  • e. We shall be uploading the user images captured from the Getepay Merchant APP which will be used for various features available in the app. Your uploading the image for the features is a consent for the same.
  • f. You are also giving your consent to access to location, contacts and storage on the Getepay APPs as required for enabling various features.
  • g. You shall, nevertheless, have an option to remove any information provided by you including your personal information. If you opt for the said option of removal, Getepay will process such request in accordance with Applicable Laws and, subject to legal, regulatory, contractual, fraud prevention, audit, dispute resolution, cybersecurity, and record retention requirements, delete, erase, anonymise, or securely archive the relevant personal information within a reasonable period.
  • h. Merchant/User authorizes Getepay to access to Location, Images, Contacts, Photos, Email id and storage on the Getepay APPS as may be required for enabling various features on the Getepay Mobile APP/Web Portal and as per compliance requirement.
  • i. We record information relating to your use of Getepay, including your location, IP address, Visited/, requested/referred URL, the searches you made. We use such information to steer Getepay toward providing the best possible level of security and service. We also make use of such information for statistical analyses of User behaviour in order to ascertain interest in and use of the various services provided by Getepay. As this type of analysis is done on aggregated information, a particular user cannot be identified.
  • j. The intellectual property rights associated with the website and its contents are owned by us. No right, title or interest in any downloaded material is transferred to the user as a result of any such downloading or copying.
  • k. Our brand, logos, product and service marks including names, trademarks, copyrights and other intellectual property matters, whether registered or not (“Our IP”) are exclusively owned by us. You agree to not display and/ or use Our IP in any manner without our prior express permission in writing. Nothing contained in this website or in the content, should be construed as granting, in any way to the User, any license or right or interest whatsoever, in and/ or to Our IP, without our express written permission.
  • l. The information collected with your use of Getepay (including your personal information) may be used to investigate, enforce, and apply our Terms of Use and Privacy Policy. We do send cookies to your computer/device in order to uniquely identify your browser and improve the quality of our service. The term “cookies” refers to small pieces of information that a website sends to your computer’s hard drive while you are viewing the site.   • m. Getepay uses third party tools, who may collect anonymous information about your visits to Getepay using cookies, and interaction with Getepay products and services. Such third parties may also use information about your visits to Getepay products and services and other web sites to target advertisements for Getepay’s products and services. No Personal Information is collected or used in this process. These third parties do not know or have access to the name, phone number, address, email address, or any Personal Information about Getepay’s Users. Getepay Users can, anytime opt-out of sharing this information with third parties by deactivating cookies, the process of which varies from browser to browser. You agree and understands (i) to maintain an updated privacy policy and consent driven architecture, to ensure that they have adequate approvals and have obtained explicit, free, informed, unconditional and unambiguous written authorization from the Customers as required by Applicable Laws, Regulatory Guidelines and any contract to access, collect, store and transmit Personal Information of the Customers using Your/ Merchant System, including Your Website or any Platform, (ii) Only to the extent applicable, that payment mechanism provided by Us are heavily dependent on Data transfer over various System and/or Platform which are neither in control of the Parties. Therefore, You agreed to take utmost measures required to secure and safe keep the System used to interface with Us as well as the underlying infrastructure which is used to host and operate such Your System and/or Platform.
4. TRANSFER OF INFORMATION
  • a. You agrees and acknowledge that usage of all Personal Information and Data in relation to the Services and Entities, including the Data and other information as received from or exchanged with Us, is in accordance with the applicable Law, including the Data Privacy Legislations, and further that usage of such Personal Information and Data is only in the Territory of India, and all related data centers/servers are situated in the Territory of India as per the RBI Guideline.
  • b. Your Personal Information is not shared by us with any third party apart from financial institutions such as banks, RBI or other regulatory agencies (as may be required) and to provide you with services that we offer through Getepay, conduct quality assurance testing, facilitate creation of accounts, provide technical and customer support, or provide specific services, such as synchronization of your contacts with other software applications, in accordance with your instructions. These third parties are required not to use your Personal Information other than to provide the services requested by you.
  • c. You hereby expressly and freely consents that We, our Affiliates, System Participants, Acquiring Banks, Subsidiaries, authorised Service Providers and any Statutory and Regulatory Authority may collect, receive, access, store, host, process, use, retain, disclose, share or transmit any data, records, documents, credential or information relating to the You (including Personal information, sensitive personal information, transactional & Payment Data, Customer Due Diligence Documents (KYC), Proof of Transaction, or such other relevant data and/or information, the “Personal Data”) in accordance with applicable Law including the Data Privacy Legislations, solely for the purpose (i) as expressly permitted for the purposes of performance of this Agreement; (ii) as reasonably anticipated by You in connection with the Services; (iii) as otherwise voluntary disclosed to or expressly authorized by the You; (iv) sharing with any third party in compliance with any order of a competent court or tribunal; (v) for such other purposes as expressly specified by Us; and (vi) to comply with or as authorized by Applicable Law, Regulatory requirements, audits, reporting obligations, dispute resolution, fraud prevention, risk management, system operations, and service enablement. You further agrees and consent that System Participants, Acquiring Banks, authorised Service Providers may further share and disclose such relevant data and/or information with their respective service providers, Subsidiaries and/or Regulatory Authority.
  • d. Your Personal Information may be shared with our parent company, subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”) that we may have in existence now or in the future, in which case we will require them to honour this Privacy Policy. If another company acquires our company or our assets, that company will possess your Personal Information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy.
  • e.
